The chancellor sustained a demurrer to the original bill filed by the complainants, and from the decree dismissing their bill complainants have appealed to this court.
The prayer of the bill is that the City of Chattanooga he permanently enjoined from further prosecuting a proceeding to condemn property of complainants for a public street; that the proceedings and attempted condemnation be declared illegal, unconstitutional and void; and that the proceedings for condemnation be removed as a cloud upon the title of the complainants to their property.
