MEMORANDUM OPINION
PAYNE, District Judge.
On February 19, 2003, David Graham (“Graham”) filed this action against defendants Pactiv Retirement Plan, Plan No. 031 (the “Pactiv Plan”) and the Pactiv Corporation Benefits Committee (the “Pactiv Benefits Committee”), seeking redress for several alleged violations of the Employment Retirement Income Security Act of 1974 (“ERISA”), 29 U.S.C. § 1001, et seq.
