The complaint in this suit was filed in the District Court of Huerfano County May 20th, 1913. It alleges that the plaintiffs and others similarly situated were the owners of water rights in Water District No. 16, consisting of the Huerfano River and its tributaries, including Pueblo and Huerfano Counties; that the defendants, Field, State Engineer; Chew, Division Engineer; Brown, Water Commissioner, were shutting down plaintiffs’ headgates for the benefit of the other defendants, who owned rights further down the stream which they claimed…
