This appeal involves two cases filed in the district court of Eddy County, New IVlexico, which were consolidated for trial and are consolidated here.

The plaintiff (appellee) is a quasi municipal corporation. The issues in the two cases are substantially the same. The complaints allege in substance that appellant was organized by the water users under the Carlsbad Irrigation Project on the Pecos River to provide for the irrigation of their lands in the Carlsbad Project, in cooperation with the United States under the Federal Reclamation laws for the general purpose of…
