DAWSON, District Judge.
This is a motion brought by Big Boy Manufacturing Co., one of the defend ants in the above captioned action, to dismiss the complaint as against it pursuant to Rule 12(b) (3) of the Rules of Civil Procedure, 28 U.S.C., on the ground of improper venue. The complaint charges the defendants with patent infringement and prays for injunctive relief as well as for an accounting and damages flowing from the alleged infringement.
