The instant lender liability action stems from the financial harm allegedly suffered by Temp-Way Corporation (“Temp-Way”) and Denis J. Spellman and Martin F. Spell-man (“the Spellmans”), resulting from a banking relationship with Continental Bank (“Continental”) and several of its officers and employees, namely, Ronald Vicari, Frank Leis, and Francis Conway (the “defendants”). 1 Temp-Way and the Spell-mans (hereinafter collectively referred to as “plaintiffs”) assert claims for breach of fiduciary duty, breach of financing agreement, business coercion…
