Plaintiffs Joan Smith, as administratrix of the estate of Anita Smith, and Jaquione Johnson (collectively, the “Wendy’s plaintiffs”) bring their actions as a result of injuries suffered during a violent robbery at a Wendy’s restaurant in Queens, New York, on May 25, 2000. (See Wendy’s Pls.’ Letter, dated April 2, 2004, at 1).
