Appeal by the plaintiff, Frank T. Morrill, from an order of the Supreme Court, made at the New York Special Term and entered in the office of the clerk of the county of New York on the 25th day of June, 1896, requiring the plaintiff to serve a bill of particulars.

Per Curiam :
The only ground upon which the bill of particulars was applied for was that it was necessary to enable the defendant to answer. It was not necessary for that purpose. The action is for a breach of a contract to take and pay for certain cigai’ettes sold by the plaintiff to the defendant and one Timayenis under a written contract. The plaintiff alleges the making of the contract in writing and that under it the plaintiff sold to the defendant, and the defendant purchased and promised to pay for, all the right, title and interest of the *305plaintiff in and to the business conducted…
