In this action for declaratory and injunctive relief, the Pharmaceutical Manufacturers Association (“PMA”), on behalf of its members, 1 seeks a preliminary injunction restraining the Secretary of Health, Education and Welfare (“the Secretary”) and the Commissioner of Food and Drugs (“the Commissioner”) from taking any action in reliance upon the regulations contained in the Commissioner’s Order of September 19, 1969 (“the September regulations”), 34 Fed.Reg. 14596.
