OAKES, Circuit Judge:
This appeal is from an order dismissing the complaint. 337 F.Supp. 1289 (S.D.N.Y.1972). It raises not insignificant questions concerning the applicability of the Administrative Procedure Act, 5 U.S.C. § 551 et seq., to certain procedures of the Secretary of Labor in connection with the entry of aliens for the purpose of performing labor in the United States.
