This matter comes before the court on the cross motions of plaintiff Allen Payne (“Payne”) and defendant General Motors Corporation (“GM”) for partial summary judgment. Payne filed this action against his former employer, GM, alleging race and sex discrimination in violation of Title YII of the Civil Rights Act of 1964, race discrimination in violation of the Reconstruction Era Civil Rights Act (42 U.S.C. § 1981), and negligent infliction of emotional distress.
