Appellant George Wilcox appeals the interim order of the Pulaski County Circuit Court denying his motion to dismiss. For reversal, appellant argues that the State is barred by double jeopardy from retrying him on the charge of first-degree battery. The trial court’s denial was affirmed by the Arkansas Court of Appeals in Wilcox v. State, 70 Ark. App. 110, 15 S.W.3d 353 (2000).
