OPINION

DROWOTA, Justice.

In this tort action Plaintiff seeks damages for personal injuries suffered while working on a utility pole belonging to Defendant, United Inter-Mountain Telephone Company. Plaintiff’s immediate employer, Wright and Lopez Construction Company, was performing work for Defendant pursuant to a contract. Plaintiff recovered worker’s compensation benefits from Wright and Lopez and thereafter sued the Telephone Company in tort. Defendant moved for summary judgment on grounds the suit was barred by the principal contractor provision of the Worker’s Compensation Act, T.C.A.…
