TOMLIN, Judge.

The plaintiff appeals to this Court from the judgment of the Circuit Court of Shelby County, granting defendant’s motion for summary judgment. Plaintiff had sued for damages as a result of injuries received while working on the premises of defendant. Judge James Tharpe held that defendant was immunized from suit in tort by the Tennessee Worker’s Compensation Act. Two issues are presented for our consideration: (1) whether the defendant was a co-employer of plaintiff at the time of his alleged injury; and (2) whether plaintiff is limited to a cause of action under the Worker’s…
