Petitioner, the National Labor Relations Board (“the Board”), seeks enforcement of an order it issued against respondent, The Salvation Army of Massachusetts Day Care Center (“the Center”), requiring the latter to resume collective bargaining with its employees’ union representative. The Board claims that it has jurisdiction over the religiously affiliated Center and that the Center’s “religious purpose” is not a mandatory collective bargaining subject.
