In April, 1882, the appellee, Doctor G. Powell, filed in the Gibson Circuit Court a, petition for a divorce from appellant, and for the custody of their children. In May following, appellee filed .an answer in general denial. On the same day, appellant filed an affidavit for a change of venue, on the ground of the alleged bias and prejudice of the judge. This motion was sustained on the 28th day of August, 1882, and a change from the judge having been granted in four other cas'es, the judge, on that day, by a regular and written appointment, appointed Hon.
