This was an action by the appellant against the appellee to obtain a divorce. The appellee answered the complaint by a denial and filed a cross complaint, in which she sought a divorce, alimony, and the custody of her daughter, Ida Musselman. The appellant answered the cross complaint.

The cause was submitted to the court for trial, and after the evidence had all been heard, the appellant dismissed his complaint. The court thereupon rendered a finding upon the cross complaint in favor of the appellee. The appellant moved the court for a new trial, assigning therefor twenty-one reasons. The…
