Allen v. State

Indiana Supreme Court

Decided December 13, 1999No. 49S00-9801-CR-25PublishedCited by 37 opinions

1Opinion of the Court

SHEPARD, Chief Justice.

Defendant Aonzo Alen was convicted of murder and two counts of criminal deviate conduct for the death of Nikita Jackson. The trial court sentenced him to 165 years.

Alen presents four claims of error in this direct appeal:

1. That the trial court erred in admitting evidence of another crime for which Alen was charged and tried but not convicted;

2. That the prosecutor engaged in misconduct during his closing argument;

3. That there was a material variance between the information charging Alen and the proof presented at trial; and

4. That Alen’s sentence is unreasonable.
