The National Labor Relations Board (the “Board”) petitions for enforcement of its order directing McCarty Farms, Inc. (the “Company”) to bargain with United Food and Commercial Workers International Union, Local 1529 (the “Union”). The Company refused to bargain after the Union won the election because it asserted that the election was tainted by pro-union misconduct.
