Auto Acceptance & Loan Corp. v. Taus
Wisconsin Supreme Court
1Opinion of the CourtCurrie, C. J.
The issues attempted to be raised by appellant bank on this appeal are:(1) Is the trial court’s finding, that plaintiff’s mortgage of March 16, 1961, was given in renewal of plaintiff’s mortgage of October 3, 1960, contrary to law or the great weight and clear preponderance of the evidence ?(2) Does the order modifying judgment sufficiently protect defendant bank’s right to have adjudicated the issue of marshaling of assets raised by its motion for review ?(3) Does the evidence support the finding that plaintiff is entitled to $3,918.93 interest on the March 16, 1961, mortgage note ?
