Defendant Samuel Chenault, Jr. (colored, aged 26) was charged with and convicted by a jury of entering the Singer Grocery Store in Fresno with intent to commit theft therein. A motion for new trial was denied. At the trial it was stipulated and established that the grocery store in question was burglarized sometime between 7 p. m. of November 21, and 10 a. m. of November 22, 1945, by a breaking of the rear door and that rolls of pennies, nickels and dimes, together with certain groceries, cigarettes, a radio, and ladies’ wearing apparel were taken.
