In Count I of an information filed by the district attorney of Los Angeles County, defendants Peter M. Theodore and Charles E. Melton were charged with criminal conspiracy to commit grand theft, 21 overt acts being set forth. In Counts II, III, IV, V and VI, defendant Theodore only was charged with grand theft, each count alleging the felonious taking of money from Fay B. Langendorf.

The jury returned verdicts of guilty as charged upon all counts of the information. Motions for a new trial were denied and judgments pronounced, execution thereof being suspended and defendants granted…
