The bill of exceptions states that “this was an action in negligence wherein it was alleged that defendant maintained and controlled a dam at the outlet of Mooseleuk Lake; that defendant negligently released impounded water from Mooseleuk Lake, thereby causing ice to be dislodged in Mooseleuk Stream and Aroostook River, thereby causing ice to jam adjacent to and below land of plaintiff in Oxbow Plantation approximately 30 miles from Mooseleuk Dam, thereby…
