COHN, J.
The case was heard on April 20, 1976, in the Municipal Court, Central Judicial District, County of San Mateo. Motion for a nonsuit was granted at the close of plaintiff’s case.
The facts presented in this case are essentially undisputed. Appellant was employed by respondent, Dick Bullís, Inc., as an automobile salesperson. Compensation was based upon commissions earned plus a $500 a month draw.
