Petitioner Jerome W Mitchell and the Illinois Department of Human Resources (the DHR) filed a complaint with the Illinois Human Rights Commission (the Commission) pursuant to the Illinois Human Rights Act (the Act) (775 ILCS 5/1 — 101 et seq. (West 2002)) alleging that Mitchell’s employers, the Illinois Department of Corrections (the Department) and Prison Health Services (PHS), a private corporation operating out of Newcastle, Delaware, had discriminated against him on the basis of race when they did not promote him to the position of dental director.
