MEMORANDUM OPINION
DIANE WEISS SIGMUND, Bankruptcy Judge.
Before the Court are the motions (“Motions”) for judgment on the pleadings filed by defendants, Fairbanks Capital Corporation (“Fairbanks”) and Cityscape Corporation (“Cityscape”). 1 Fairbanks’ Motion seeks the dismissal of Count I of plaintiff Darlene Roberson’s (“Plaintiff’) complaint (“Complaint”). 2 Cityscape’s Motion is also directed at Count I as well as Counts II and III. 3 Counts I and II allege claims based on the Truth in Lending Act (“TILA”), 15 U.S.C. § 1601 et seq. and the Real Estate Settlement Procedures Act (“RESPA”), 12…
