This bill for declaratory relief comes to us by way of a report by the Superior Court pursuant to Mass.RCiv.P. 64, 365 Mass. 831 (1974). The case was submitted to the trial judge on a case stated.2 The judge made rulings of law and reported those rulings to us for a determination of their correctness. We summarize the facts.
