Action to recover the amount of certain notes, upon which it was claimed that the defendant was liable as a partner with the maker; brought to the Superior Court in New Haven County, and tried to the court before Thayer, J. This action is brought to recover the amount of two notes signed by Edward L. Kimberly of the following description:—
“ ($24,000.) New Haven, Connecticut, March 1st, 1882:
“On or before five years after date, for value received, I promise to pay to the order of Stephen L. Usher twenty-four thousand dollars, with interest at the rate of six per cent per annum, payable semi-annually, together with all taxes assessed upon said sum against said Usher or the holder Of this note.
