In the opinion, which I am now to express, on this case, I shall waive considering the objections made to that part of the charge, which, after mentioning what is understood by being an infidel, declares, that the acts specified “ are crimes punishable by statute.” Whether there is such a repugnance between the constitution and the law referred to, as necessarily to imply a negative of it, and amount to an implied repeal, 1 have not had leisure to examine.
