1. Background
This action is part of a multi-district securities litigation pending before this Court. In re Adelphia Commc’ns Corp. Sec. and Derivative Litig., No. 03 MDL 1529.
In the instant case, the Wellsville Group has brought a securities fraud class action on behalf of itself and all stockholders of Adelphia Business Solutions, Inc. who purchased their securities between January 6, 2000 and March 27, 2002 (collectively “plaintiffs”). 1 (Compl. ¶¶ 1, 12-20.)
