The plaintiff, Gregory 0. Smith, initially filed this action in the Circuit Court for Montgomery County seeking damages for alleged libel and invasion of privacy arising out of the publication of the March, 1977 edition of Esquire Magazine. This action was then properly removed to this court 1 , where there is presenting pending a Motion to Dismiss filed on behalf of the defendant. (Paper 10).
