The following is a fairly accurate statement of the transactions leading up to the filing of this suit:

On November 6,1919, Greater Houston Improvement Company, by its deed of that date, conveyed to Robert Funkhouser the south 25 by 125 feet of Lot 18 and the adjoining north 25 by 125 feet of Lot 19, block 16, Montrose addition, known as 3619 Audubon place. In consideration for such conveyance, Funkhouser executed and delivered to said company certain notes which were secured by vendor’s lien and also by a deed of trust executed by Funkhouser.
