ORDER

JUSTICE, Chief Judge.

Before the court in the above-entitled and numbered action is the motion of one defendant, the Texas American Bank— Town North (Bank), for summary judgment. For the reasons set forth below, the motion shall be granted in part, and denied as to the rest.

In his complaint, plaintiff Charles Hampton (Hampton) alleges that the defendants violated the 1934 Securities Exchange Act, 15 U.S.C. §§ 78a et seq., the Texas Securities Act, Tex.Civ.Stat. arts. 581-1 et seq., various Texas stock fraud statutes, see Tex.Bus. & Commerce C. §§ 27.01 et seq., and the civil provisions of…
