The defendant was convicted of the crime of canning salmon without first having obtained a license therefor, alleged to have been committed in Curry County, July 18, ■1907. He appeals from the judgment which followed, assigning as error the action of the court in overruling a demurrer to the information, interposed on the ground that the facts stated therein do not constitute the commission of a crime.
