ORDER
LAND, District Judge.
In this case, Plaintiff, the beneficiary under a life insurance policy issued to her husband by Defendant, seeks to recover proceeds under the policy. Defendant contends that it is entitled to rescind the policy and that it is liable only for premiums paid because the insured made material misrepresentations, in his insurance application.
