¶ 1. This case is before this court on certification from the court of appeals pursuant to Wis. Stat. § (Rule) 809.61 (2005-06). 1 The defendant, John A. Wood (Wood), is committed to the custody of the Department of Health and Family Services (DHFS), after having been found not guilty of a crime by reason of mental disease or defect (hereinafter described as "NGI"). DHFS placed him at Mendota Mental Health Institute (Mendota), where he has been a patient since 1999.
