This controversy had its origin in a movement by railroad carriers to furnish, to their patrons a collection and delivery service to and from the railroad terminals of freight in less than carload lots (hereinafter referred to as 1. c. 1. freight) by means of motor vehicles. A large number of carriers by rail entered into a written contract with Railway Express Agency, Inc., for the performance of this pick-up and delivery service as the agent of the railroad companies.
