Plaintiff Cheryl Mayers, a forty-seven year old African American woman, brings this action against defendants Emigrant Bank, Year 2000 Amended and Restated Severance Pay and Outplacement Program of Emigrant Savings Bank, Janet Martin, Kimberly Romano and Stephanie Nipe (collectively, “Emigrant” or “defendants”) alleging violations of the New York State Human Rights Law (“NYSHRL”), New York City Human Rights Law (“NYCHRL”) and the Employee Retire ment Income Security Act (“ERISA”).
