Defendant was convicted of embezzlement. The information charged that he was the agent and employee of the Midvale State Bank and as such, fraudulently appropriated to his own use the sum of $1,000- on January 2, 1926, which came into his possession and under his control by virtue of his employment. From the conviction and the judgment imposed upon him, he has appealed to this court.
A brief statement of the facts will aid in understanding the questions presented by the assignment of errors.
