INTRODUCTION
Shawn Hunt (“Plaintiff’) sustained injuries in a farming accident, when the tractor he was operating was struck from behind by another tractor, after the second tractor’s brakes failed. Plaintiff is asserting claims for negligence and strict products liability against CNH, Inc. (“Defendant”), the manufacturer of the tractor which struck him.
