OPINION AND ORDER
DUGGAN, District Judge.
On April 13, 2006, the Bankruptcy Court issued an Order which converted the case from a proceeding under Chapter 11 of Title 11 of the United States Code to a proceeding under Chapter 7 of Title 11 of the United States Code. On June 19, 2006, this Court granted Monroe Bank & Trust leave to appeal the Order. Presently before the Court is Monroe Bank & Trust’s motion to have the April 13, 2006 Order vacated and the matter remanded to the Bankruptcy Court for an evidentiary hearing on the question of whether a dismissal or conversion of the case is in the…
