Plaintiffs as citizens and taxpayers of Madison County instituted this action to restrain the board of county commissioners (1) from electing or appointing W. G. Buckner tax collector, or permitting him to exercise the duties of tax collector; (2) to restrain the defendant from permitting J. M. Baley, Sr., to have the delinquent tax books, or to perform duties as delinquent tax collector; (3) to restrain defendant from paying any county funds to W. G. Buckner or J. M.
