For some time prior to April 5, 1910, appellant and appellee were the owners respectively of the Bacon Lumber Company and the A. S. Mc-Ilvaine Lumber Company, and on that date they entered into the following written contract with reference thereto:
“This agreement made and entered into this 5th day of April, A. D., 1910, by and between Thomas J. Christian of Indianapolis, Indiana, ' and Chas. S.
