Combs sued Maoy, before a justice of the peace, for certain articles purchased at a stove and tin-shop. Maoy answered that one Carlisle was a partner when, &c., in the profits and losses of said shop.
There were several trials, with divers results. The defendant eventually appealed to the Common Pleas Court, where there was 'a trial, finding for plaintiff, and judgment.
