MEMORANDUM ORDER

HIRAM H. WARD, District Judge.

This matter came on for hearing before the Court on March 21, 1975 on defendant’s motion for summary judgment under Rule 56, Federal Rules of Civil Procedure. Counsel for plaintiff conceded in open court that plaintiff no longer seriously pursues the breach of warranty claim against the defendant and, therefore, the defendant’s motion for summary judgment was based solely on the contention that the plaintiff’s negligence claim was barred, as a matter of law, by the North Carolina statutes of limitation.
