This case was before this court on a former appeal, and the decision of this court is reported in 34 Mo. App. 675. On its being remanded to the circuit court in pursuance of the mandate of this court, the defendant filed an amended answer in that court, setting up the special defense upon which it has chiefly relied. So much of this amended answer as it is material to recite is as follows: “That, on the twenty-fifth day of February, A.
