MEMORANDUM OPINION AND ORDER

VAZQUEZ, District Judge.

THIS MATTER is before the Court on Intervenor’s Motion for Summary Judgment [Doc. No. 33], Defendants’ Motion for Summary Judgment [Doc. No. 39], and Plaintiff National Labor Relations Board’s Motion for Summary Judgment [Doc. No. 47] all filed May 1, 1998. Also before the Court is Ami-cus Curiae National Right to Work Foundation’s Memorandum and the parties’ responses to the amicus brief.
