The contention of attorneys for plaintiffs in error is that as all of their warrants were duly approved and allowed by the commissioners appointed by the- district judge under the act of the legislature, and by him certified to the mayor and city council of Guthrie, who were directed to issue warrants for their payment, and as the mayor and city council after repeated demands for said levy, have neglected, failed and refused to make said levy for an unreasonable length of time, to-wit: nine years, for these reasons the city is liable fo.r the indebtedness…
