This is an appeal from an order of the General Term, fourth department, reversing a final order and judgment of the Special Term, which denied relator’s application for a peremptory writ of • mandamus to complete the collection of an assessment or to compel the issue of bonds in accordance with the charter of the city of Syracuse, in order to pay the relator for constructing a sewer.
