The prosecution appeals as of right from the circuit court’s final order of acquittal/dismissal/remand of the charges against defendant. We reverse and remand.

1. FACTS

Defendant was charged with two counts of open murder, MCL 750.316; MSA 28.548, and two counts of possession of a firearm during the commission of a felony, MCL 750.227b; MSA 28.424(2).
